PLEASE READ THE FOLLOWING USAGE RULES BEFORE CONTINUING IN teenweb.org.

Teenweb.org is a web site of the Berkshire Coalition to Prevent Teen Pregnancy, hereinafter known as the Coalition.

OUR RESPONSIBILITIES
    We warrant neither access to teenweb.org will be uninterrupted nor that any material appearing therein will be error-free. Although we intend to take reasonable steps to prevent the introduction of any virus, worm, Trojan horse, or other contaminating or destructive feature, we warrant that neither teenweb.org nor any sites/materials that may be downloaded, uploaded, posted, or linked will be free from any of the above mentioned situations. We are not liable for any damages or harm attributed to such features. If you rely on the site and/or any materials contained herein, you do so at your own risk. We do not endorse the accuracy, completeness, timeliness or reliability of any advice, opinion, statement or other material or database displayed, uploaded or distributed through available links or teenweb.org.

    The Coalition reserves the right to disclose any personal information about you or your use of teenweb.org if the Coalition has a good faith belief that such action is necessary to comply with state, federal, or international law, conform to legal requirements, protect and defend the rights and/or property of the Coalition, enforce the terms of this usage agreement, or act to protect the safety and/or interests of its users or others. The laws that apply in the offline world must be obeyed online as well. The Coalition has zero tolerance for illegal behavior and will terminate use of the service and cooperate fully with law enforcement on such matters.
    The Coalition cannot verify the accuracy of statements that users place on teenweb.org. We are not in the position to investigate and confirm the accuracy of information placed on the site by its users; therefore, the Coalition reserves the right to review materials posted to teenweb.org and to remove any materials and terminate your access to any or all of the site at any time, without notice, for any reason whatsoever, at our sole discretion.

    The Coalition currently offers the use of teenweb.org as a free service. The Coalition reserves the right to charge a fee for the use of teenweb.org at any time, as they may seem fit in the future, with proper notice. We reserve the right to change the Usage Rules or to modify any features of teenweb.org at our discretion.

YOUR RESPONSIBILITIES

    Any vulgar language, crude or explicit sexual references, discussion of illegal drugs, hate speech, advocating violence, and/or discrimination in any form is inappropriate and will not be tolerated. If you disagree with someone, respond to the subject, not the person. If you wouldn’t say something in a room full of people you have never met please don’t post it on our message boards. Teenweb.org does not endorse nor oppose the opinions of any guest, but may take issue with the manner in which an opinion is expressed. We reserve the right to remove any content that is objectionable to us for any reason. The Coalition makes the final decision, which is at our sole discretion, and is final about what is appropriate or not.

    You will be responsible for any and all liability resulting from publication, distribution or redistribution related to material you post or the use of such material by any person. You will be responsible for any liability resulting from any virus, worm, Trojan horse, or other contaminating or destructive feature. Upon request by the Coalition, you agree to defend, indemnify and hold harmless teenweb.org. The Coalition and its parent, affiliates, subsidiaries, employees, contractors, officers, directors, vendors, and content providers from all liabilities, claims and expenses, including attorneys' fees, that arise from a breach of this Agreement for which you are responsible or in connection with your transmission of any Content on teenweb.org. The Coalition reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In that event, you shall have no further obligation to provide indemnification to the Coalition in that matter.

THIRD PARTY LINKS

    Teenweb.org may contain links to third party sites. These sites are not under the control of Coalition and therefore the Coalition is not responsible for content, including without limitation any links contained within the third party sites or any changes or updates to a site. The Coalition is not responsible for web casting or any other form of transmission neither received from any linked site nor is the Coalition responsible if the linked site in not working properly. The Coalition is providing these links as a convenience only and the inclusion of any link does not imply endorsement of or any association with the linked site or its operators by the Coalition. You are solely responsible for viewing and abiding by the privacy statements and terms of use posted at the linked sites. Any dealings with third party sites, including advertisers, including the delivery and/or payment for goods and services, and any other terms, conditions, warranties or representations associated with such dealings or promotions, are solely between you and the advertiser or other third party. The Coalition shall not be responsible or liable for any part of any such dealings or promotions.

POSTING RULES

    You agree to abide by the following rules when posting material and content on teenweb.org. You will not:
    • Post any messages or materials anonymously or under a false name and you agree that you are solely responsible for any statements that are posted using your account.
    • Publish, post, upload, distribute, or disseminate any inappropriate, profane, discriminatory, defamatory, obscene, indecent or unlawful material, topic, name, information or links to material (including, but not limited to text, content, photos, video, animation, graphics, audio, or software) that is, libelous, harassing, pornographic, violent, or a violation of applicable law or that would constitute grounds for civil liability.
    • Post materials in a particular discussion area that does not pertain to the topic.
    • Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as privacy and publicity rights) of others.
    • Post advertisements, surveys, contests, pyramid schemes, chain letters, junk email, spamming or any duplicative or unsolicited messages (commercial or otherwise), charity requests, petitions for signatures, and/or offer to sell or buy goods or services, or any solicitation of any kind of other users.
    • Post materials for which you have not obtained appropriate copyright or other permission to upload such materials and you will only permit downloading by other users for personal, noncommercial use.
    • Upload, or otherwise make available, files that contain images, photographs, software or other material protected by intellectual property laws, including, but not limited to, copyright or trademark laws (or by rights of privacy or publicity) unless you own or control the rights thereto or have received all necessary consents to do the same.
    • Use any material or information, including but not limited to, images or photographs, in any manner that violates, plagiarizes, or infringes any copyright, trademark, patent, trade secret, privacy, personal, or other proprietary right of any party. You acknowledge that any materials you upload will be considered to be in the public domain.
    • Impersonate another person, indicate that you are an employee or representative of the Coalition, or attempt to mislead another user by stating that you represent the Coalition and/or any partner’s or affiliates.
    • Publish, post, upload, distribute or disseminate any topic, name, material or information that incites discrimination, hate or violence towards one person or a group because of their belonging to a race, a religion or a nation, or that insults the victims of crimes against humanity by contesting the existence of those crimes.
    • Upload files that contain viruses, Trojan horses, worms, time bombs, cancel bots, corrupted files, or any other similar software or programs that may damage the operation of another's computer or property of another.
    • Download any file posted by another user that you know, or should reasonably know, cannot be legally distributed in such manner.
    • Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of origin or source of software or other material contained in a file that is uploaded.
    • Restrict or inhibit any other user from using and enjoying teenweb.org.
    • Violate any code of conduct or other guidelines, which may be applicable.
    • Violate any applicable laws or regulations.
    • Use, download or otherwise copy, or provide (whether or not for a fee) to a person or entity any directory of users or other user or usage information or any portion thereof.

    LIABILITY DISCLAIMER

      The information, software, products, and services included in or available through the Coalition site may include inaccuracies or errors. Changes are made periodically to the site and information. Teenweb.org should not be relied upon for personal, medical, legal or financial decisions. The Coalition and or its suppliers make no representations about the suitability, reliability, availability, timeliness, lack of viruses or other harmful components and accuracy of the information, software, products, services and related graphics contained herein for any purpose. All such information, software, products, services and related graphics are provided “as is” and “as available” basis for your use, without warranties of any kind, either expressed or implied, unless such warranties are legally incapable of exclusion. The Coalition hereby disclaims all warranties and conditions with regard to this information, software, products, services and related graphics, including all implied warranties and conditions of merchantability, fitness for a particular purpose, workmanlike effort, title, and non-infringement.

      The information appearing on teenweb.org is intended solely as general guidance and does not constitute legal, medical, personal, or financial advice. In no event shall teenweb.org, the Berkshire Coalition to Prevent Teen Pregnancy, its subsidiaries, affiliates, employees, officers, directors, or its parents be liable for any direct, indirect, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, unauthorized access to or alteration of your transmissions, any material or data sent or received or not sent or received, or any transactions entered into through teenweb.org. You specifically agree that the Coalition is not responsible or liable for any threatening, defamatory, obscene, offensive or illegal content or conduct of any other party or any infringement of another's rights, including intellectual property rights. You specifically agree that the Coalition is not responsible for any content sent using and/or included in the teenweb.org site by any third party.

      You acknowledge and agree that the Coalition, its parent, subsidiaries and affiliates are not liable for any act by them or any other person regarding conduct, communication or content on the service or use of teenweb.org. In no case shall the Coalition, its parent’s subsidiaries’, affiliates’, employees’, officers’, or directors’ (collectively or individually) liability to you exceed the amount you paid to the Coalition for use of teenweb.org. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, the Coalition, and affiliates’ liability shall be limited to the full extent permitted by law.

    This Agreement is governed by the laws of the United States of America and the Commonwealth of Massachusetts and any other international laws that are in effect.
